Terms of Service

These Terms of Service form a binding agreement between you and TOTAL TITAN HOLDINGS LIMITED ("we", "us", "TitanScout") governing your use of totaltitanholdings.com and the TitanScout product. By creating an account or by paying for any plan, you agree to these Terms. If you do not agree, do not use the service.

Section 01

What TitanScout is — and is not

TitanScout is a software-as-a-service product that uses artificial intelligence to generate viewing aids for residential property listings. Outputs include red-flag reports, repair-cost matrices, and short cinematic simulations ("scan reels") delivered through your account.

TitanScout is not a property survey, not a valuation, not a structural assessment, not legal advice, not financial advice, not insurance advice, and not a substitute for any regulated professional. Our outputs are commentary intended to inform your conversations with a RICS-accredited surveyor, a chartered valuer, a conveyancing solicitor, a mortgage adviser, or any other licensed professional whose remit covers your property decision.

You must not use TitanScout output as the sole basis for any contract, offer, valuation, mortgage application, insurance claim, court submission, expert-witness statement, or formal price negotiation.

Section 02

Eligibility & accounts

To open an account you must be at least eighteen years old and capable of forming a binding contract under the law of your jurisdiction. You agree to provide accurate information at signup and to keep that information up to date.

You are responsible for the security of your password and for all activity that occurs under your account. Notify us at support@totaltitanholdings.com if you believe your credentials have been compromised.

We may suspend or terminate accounts that breach these Terms, the Acceptable Use Policy, or applicable law.

Section 03

Subscriptions, credits & renewals

TitanScout offers three subscription tiers: Glance (free), Watchlist (paid), and Portfolio (paid). Each paid tier is billed monthly or yearly in advance through Stripe and renews automatically at the end of each billing cycle until you cancel. The renewal date and amount appear in your billing dashboard at all times.

Each plan includes a monthly credit allowance that resets on the renewal date. Credits are a service-allowance unit only. Credits are not money, not a stored-value instrument, not transferable, not redeemable for cash, and have no value outside the service.

You may also purchase top-up credit packs. Top-up credits do not expire while your account is active and your subscription is in good standing. Top-up credits are also not money and are subject to the same limitations as subscription credits.

You can change tier, switch between monthly and yearly cycles, or cancel at any time from /app/billing. Cancellation takes effect at the end of the current billing cycle.

Section 04

Fees, taxes & statement descriptor

Prices are in United States dollars and are inclusive or exclusive of taxes as indicated at checkout. Where we are obliged to charge value-added tax, sales tax, or any equivalent indirect tax, the applicable amount will be shown on your invoice.

Charges appear on your statement as TITANSCOUT AI. Stripe is the merchant of record for all transactions.

If a payment fails, we will retry on a schedule determined by Stripe. After the final retry, your subscription enters a grace period of seven days; we may suspend the service if the failure is not resolved within that window.

Section 05

Intellectual property

We and our licensors own the TitanScout software, the underlying models, the designs, the brand, and the documentation. Nothing in these Terms grants you rights to those assets beyond the limited licence to use the service described in this section.

You retain ownership of the photographs, listings, and notes you upload ("User Inputs"). You grant us a worldwide, royalty-free licence to host, process, transmit, and display User Inputs solely to provide the service to you. We do not use User Inputs to train any model.

Outputs we generate from your inputs (red-flag reports, repair-cost matrices, scan reels) are licensed to you under our Content License: a perpetual, worldwide, non-exclusive licence to use, reproduce, modify, and distribute the outputs for your personal and non-commercial decision-making, subject to the AI Disclaimer and the Acceptable Use Policy.

Section 06

Acceptable conduct

Your use of TitanScout is also governed by the Acceptable Use Policy. In particular, you must not use the service to defame an estate agent, a seller, a landlord, a tenant, or a neighbour; you must not generate content intended to manipulate property prices or sabotage transactions; and you must not present TitanScout output as a regulated survey or as legal evidence.

We may remove content, suspend access, or terminate accounts where we have reason to believe these obligations have been breached.

Section 07

Warranties

TitanScout is provided "as is" and "as available". We warrant only that we will provide the service with reasonable skill and care.

Except as required by law, we make no other warranties, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy of AI output, or non-infringement.

You acknowledge that AI outputs can contain errors, omissions, and biases. You will commission a regulated property survey before signing any contract that depends on the property's condition or value.

Section 08

Limitation of liability

Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English law.

Subject to the paragraph above, our aggregate liability arising out of or in connection with the service in any twelve-month period is capped at the greater of (i) the fees you have paid us in that period and (ii) one hundred United States dollars.

We are not liable for indirect or consequential loss, loss of profits, loss of business, loss of opportunity, loss of anticipated savings, or any loss arising because you relied on AI output rather than commissioning a regulated professional.

Section 09

Indemnity

You will indemnify and hold us harmless against claims, damages, and reasonable legal fees arising out of (i) your breach of these Terms, (ii) your breach of the Acceptable Use Policy, or (iii) third-party claims that your User Inputs infringed their rights or that you misused our outputs.

Section 10

Term and termination

These Terms apply for as long as you have an account. Either party may terminate the agreement at any time. Cancellation by you takes effect at the end of the current billing cycle.

We may terminate immediately if you breach these Terms materially, if you breach the Acceptable Use Policy, if a regulator orders us to, or if continuing to provide the service would expose us to legal risk.

On termination, we will delete your account data within thirty days, except where we are required to retain records for tax or anti-money-laundering compliance.

Section 11

Changes to these Terms

We may amend these Terms from time to time. Where the change is material we will notify registered users at least thirty days before the change takes effect. Continuing to use the service after the change takes effect constitutes acceptance.

Section 12

Governing law and disputes

These Terms are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with the service.

Before issuing proceedings, you agree to attempt to resolve any dispute by writing to support@totaltitanholdings.com and giving us thirty days to respond.
